This week, social channels and news feeds have been filled with details of a recent conflict between the Beckham family, highlighting the fact that family disputes can arise for any number of reasons, at any time, even where no previous sign of this has been present.
Nothing is more painful than conflict between family members, and every family has its conflict from time to time. The question is whether the conflict is repairable.
While family estrangements are deeply personal matters, there are circumstances where legal intervention becomes necessary, particularly when boundaries are not being respected or reputations are at stake.
We take a look at what you can do to protect yourself should you find yourself in this situation.
Harassment & Injunctions
If you find yourself being harassed by a family member or following conflict, you may need to take action to make this cease.
If you wish to enforce “no contact” but your wishes are not being respected, we can help you attain a non-molestation order (previously known as non-harassment orders or restraining orders).
We gather evidence of unwanted contact, draft witness statements, and present the case to court demonstrating why the order is necessary. These injunctions can prohibit specific types of communication—whether phone calls, texts, emails, social media contact, or physical presence at certain locations.
Equally if you find yourself being served with such requests, we can negotiate terms that are reasonable or defend against overly broad restrictions that may not be legally justified.
Defamation and Libel
For high-profile individuals, public statements or damaging social posts by family members can cause significant reputational and financial damage. If you find yourself the victim of these we can:
- Assess whether statements meet the legal threshold for defamation (are they false, published, and damaging?)
- Send cease and desist letters demanding retraction
- Negotiate settlements and public apologies
- Pursue litigation if necessary, or defend against unfounded claims
The extensive media coverage that often accompanies celebrity family disputes makes this area particularly relevant, as statements can quickly reach millions.
Contractual Disputes
Many families, have formal agreements that may be implicated in disputes. These could include family business arrangements, financial settlements or loan agreements between family members and more.
We can review any such agreements, advise on potential breaches, pursue enforcement or damages, and negotiate settlements. We can also draft robust agreements prospectively to prevent future disputes.
Making and Updating Wills
Unfortunately situations can arise where conflicts can lead to irreparable damage between family members and, where this is the case, it may result in those affected wanting to reconsider where their assets should go once they pass.
But changing a Will to exclude any individuals can give rise to potential disputes, and so it is imperative if you are looking to exclude anybody to seek professional advice.

In cases of contested probate where children are excluded from a Will, the legal framework in England and Wales provides several avenues for challenging the validity of the Will or seeking financial provision.
- One potential ground for contesting a Will is a lack of testamentary capacity. As lawyers we must follow “the golden rule” to make sure we are satisfied that a client has the required testamentary capacity to prepare a Will. If there is any doubt, we have to request a formal assessment of capacity from an expert.
- Another ground for challenging a Will is undue influence, fraud, or forgery. As lawyers we have to be satisfied that the client is not unduly influenced in anyway by anyone else to change the terms of their Will and the decision is theirs alone.
- Thirdly, if a disappointed beneficiary can prove they were financially dependent on the deceased they could bring a claim under the Inheritance (Provision for Family and Dependants) Act 1975.
We therefore have to be satisfied that everything is considered when taking client instructions to prepare a Will.
Sadly conflicts between family members is not unusual. To avoid your Will being successfully contested we strongly recommend seeking independent legal advice.

Challenging a Will
On the other side of this of course, is the person left behind unfairly by a parent, loved one or someone whom they have previously relied on financially as a result of a conflict prior to the person’s passing.
