Prenuptial
Agreements
Prenuptial agreements are a sure way to keep your assets and property attained prior to the relationship protected. In essence, taking care of your own destiny if the worst was to happen.
If you have decided to take the huge step to marry the one you love, the last thing on your mind will be what happens if things go wrong. People enter into marriage from different places in life. Whilst some are happy to share everything they own with their husband or wife to be, for others there are circumstances where they might feel differently.
- You may have been married before and already had experience of a ‘messy’ or difficult divorce.
- You may have recently inherited assets which are of a considerable sum and are weighing heavily on your mind.
- It could be the case that you have developed a business over a number of years which is your pride and joy.
A Prenuptial Agreement is an effective way to distinguish between what assets or property should be seen as open for division between the parties and what assets or property should be retained solely by one of the parties. In essence, taking care of your own destiny if the worst was to happen and the marriage was to break down. In the absence of a Prenuptial Agreement, the worst case scenario is that the division of assets would be determined by the court. This can be a lengthy and expensive process.
Prenuptial Agreements are undoubtedly increasing in their popularity and frequency. This reflects a growing desire of many couples to avoid the negative consequences of adversarial court proceedings and ultimately find a way to deal with divorce in way which is broadly pre-determined and dignified. We are aware that discussing such matters can prove to be a rather daunting and unsettling task, especially at a time when you are moving closer towards committing the rest of your life to the one you love.
However, it really is worth having that tricky conversation now as it could prevent lengthy arguments and potentially costly litigation down the line. We’re here to help and guide you. If you wish to put in place a Prenuptial agreement, the sooner you come to us, the better.
Any agreement of this nature will take time to prepare and both parties will need their own legal advice whilst the agreement is being finalised. Ideally the agreement should be in place at least 28 days before the big day. It’s certainly not a task to be left until a fortnight or week before the wedding.
